Fine Schedules Linked
Above are revised fine schedules which will become effective September 20,
2002. The new fine schedules have been adopted by the Board of Directors of
the Association to adhere to the provisions of NRS 116, the statute governing
common interest communities. The Board has also separated fines and
enforcement actions of Contractors from
Association Members. This is to
recognize that although Owners are ultimately responsible for the violations
caused by their Contractors and subcontractors, it is the Contractor who is on
the premises and should be held initially responsible for adherence to the
Contractors Rules and Regulations adopted by the Architectural Committee.
Since Contractors are not parties to NRS 116, they may be subject to different
enforcement actions than Owners. The
Fine Schedule for Members continues to be lenient with first time offenses.
The purpose of a compliance process and fine schedule is to achieve compliance
with the governing documents of the Association, and not intended as a source
of income for the Association. Many violations are caused by forgetfulness or
lack of familiarity with the provisions of the governing documents. As a
result, the individual fine amount for the first time violation of any
provision has been reduced to $50, and will be automatically waived if the
violation is remedied in the prescribed time. However, repeated offenses of
the same provision will be dealt with more severely. Together
with the new fine schedules the Association's Property Manager will be making
more frequent drives thru the property. While the Property Manager and
members of the Board are the most frequent source of notices of violation,
there are a number of complaints received from our Members. The Compliance
Enforcement Process will be modified to provide feedback to these Members in
the form of an acknowledgement of receipt of the complaint. However, no
specific enforcement action will be disclosed. One
of the primary responsibilities of the Board is to enforce the provisions of
the governing documents. The purpose of these provisions is to insure that
property values remain at the highest possible levels and that the visual
appearance of the community meets the high standards of the Association. This
job is made easier if we all familiarize ourselves with the CC&R's, and
Rules and Regulations adopted by the Board, and conscientiously adhere to
them. Thank
